Can my Honolulu boss cut my hours if his work truck hurt my kid?

The one thing your employer is hoping you never find out is this: your child's injury claim belongs to your child, not your boss or the company.

The outcome usually turns on three big factors:

1. Who caused the injury, and where it happened. If a company truck hit your child in Honolulu, the claim may be against the driver, the company, or both. If it happened in a road work zone with lane shifts, flaggers, or heavy equipment, photos, witness names, truck numbers, and HPD's traffic report matter fast. If your child was treated at The Queen's Medical Center, keep every record and bill. If a public agency was involved - like a city vehicle or school-related transportation - do not assume the normal minor rules give you forever.

2. Who files the claim for a minor. In Hawaii, a parent or legal guardian usually brings the claim on the child's behalf. A child generally cannot sign a release alone. If there is a settlement, court approval may be required, especially when the amount is significant or money must be protected until the child turns 18. Hawaii also has a tolling rule for minors under HRS § 657-13, which can pause the normal 2-year injury deadline, but waiting is still dangerous because video gets erased and witnesses disappear.

3. What your boss does after you speak up. A sudden cut in hours, schedule changes, or pressure to "let it go" does not wipe out the claim. It can become important evidence of retaliation or intimidation. Save texts, pay stubs, schedules, and any messages about your job after you report the incident. If the company insurer calls, remember they are trying to lock down statements early, often before the full extent of a child's injuries is clear.
